Brazil’s National Telecommunications Agency (Anatel) issued Resolution No. 780/2025 on August 1, published August 4, amending the Regulation on Conformity Assessment and Homologation of Telecommunications Products (Resolution No. 715/2019). The update introduces new rules on marketplace liability, sanctions for non-compliance, refurbished products, and data center conformity—key changes that affect manufacturers, importers, and digital platforms.
Key Updates in Anatel Resolution 780/2025
1. Marketplace and Digital Platform Liability
Marketplaces and online platforms now share joint liability for the sale of irregular telecom products.
Even platforms that only publish or promote advertisements are responsible.
Products sold online must include the Anatel homologation code in listings.
2. Expanded Sanctionable Conduct
Through amendments to Articles 83–85, Anatel clearly defines punishable violations:
Commercialization, importation, or use of non-homologated products
Importation outside approved technical requirements
Invalid homologation codes or fraud
Non-compliance with commitments
Sanctions include suspension for up to two years, revocation of designations, or communication to Inmetro.
3. Refurbished and Reconditioned Products
Must comply with regularity requirements.
May be assessed for public policy purposes.
May receive a different homologation code from the original product.
4. Consumer Protection Code Application
The regulation explicitly applies the Consumer Protection Code (CDC) to commercial relationships, strengthening consumer rights in telecom product sales.
5. New Rules for Data Centers
New data centers must pass conformity assessment before installation or contracting.
Existing data centers have three years to comply.
Effective Dates
Resolution effective August 4, 2025.
Articles on marketplace liability and sanctions (Articles 2 and 3) will take effect four months later.
